Frequently Asked Questions (last updated March 2018)

National civil rights and personal injury attorney Ben Crump of Ben Crump Law, PLLC has been retained by the family of Stephon Clark, an unarmed 22-year-old black man who was shot dead in his grandmother’s yard by Sacramento police on Sunday, March 18. Officers who were responding to a 911 call about a man tampering with vehicles saw and approached Clark, then shot 20 times.

QUESTION: What does Attorney Crump have to say about this tragedy?

  • “The shooting death of Stephon Clark is an all-too-common tragedy. It is yet another troubling example of a young, unarmed black man being shot by police under highly questionable circumstances. From what we have seen so far, Sacramento law enforcement’s actions – both before and after the shooting – have raised more questions than provided answers. All of us who are committed to social justice are demanding full transparency and answers as to how these tragic events unfolded.”

QUESTION: What does Attorney Crump have to say about the autopsy results? What are next steps?

  • “In the beginning, the Sacramento Police Department attempted to mislead Stephon Clark’s family about why they shot at him 20 times in his own backyard. Given the findings of our independent autopsy, we find that the truth is outrageous — he was shot almost entirely in the back, which contradicts their narrative that he was charging toward them when they opened fire. This affirms that Stephon was not a threat to police and was slain in another senseless police killing under increasingly questionable circumstances.”

QUESTION: Was Dr. Omalu hired or did he volunteer?

  • The family retained Dr. Omalu to do the independent autopsy.

QUESTION: Is there any additional information about the autopsy you can disclose?

  • This is all the information we can disclose at this time.

QUESTION: Are there photos available that media is approved to publish, and who should be credited?

QUESTION: What kind of lawsuit is being filed? Who is being sued? When will the lawsuit be filed?

  • “We’re exploring every legal remedy possible to get justice for Stephon Clark.”

QUESTION: How does Attorney Crump feel about the announcement made by the Attorney General’s Office?

  • “We fully expect that the California Attorney General’s Office will do a complete and thorough investigation that is fair and impartial — and that extends due process not just to those being investigated, but equally to the family of Stephon Clark.”

QUESTION: How does the police body camera footage and the sharing of that early on affect this case?

  • “It’s always better to have a recording of what happened, because it sheds light on the actions of everyone involved. It was a positive step for police to do that, because transparency plus accountability equals trust. There have been countless cases where video or audio recordings have shown events as they actually occurred, not as the participants – including law enforcement officers – have described them. So we are thankful that the Sacramento Police Department has provided video evidence that their officers fired on Stephon before giving him a chance to show the innocent phone he was carrying, and we are certain it will help prove that Stephon was gunned down for no justifiable reason.”

QUESTION: What about the muting of the mic, what is your opinion?

  • “The family feels that the muting of the mics suggests they were up to something nefarious; to them it suggests they were conspiring to be deceitful.”

QUESTION: Can you confirm Stephon Clark’s age?

  • He was 22. His birthday was August 10, 1995. He would have been 23 this year.

QUESTION: Information about wake/funeral scheduled for Thursday, March 29?

QUESTION: Who is Kristena Rodriguez Johnson? Can Attorney Crump confirm whether she in fact knew Stephon and is a legitimate source?

  • We cannot speak to this information at this time.

QUESTION: Is the gofundme page legitimate?

  • We cannot speak to this information at this time.

QUESTION: What other family members can media reach out to?

  • We cannot speak to this information at this time.

QUESTION: I would like to confirm that Stephon Clark converted to Islam during his life? Is his family Christian?

  • We cannot speak to this information at this time.

QUESTION: Thank you, could you please email me the names of the mother and grandmother of Stephon Clark?

  • The only name we can confirm the spelling for is his grandmother Sequita Thompson.
